Welcome to SafeBites. These Terms of Service ("Terms") govern your use of the SafeBites mobile application (the "App"). By downloading, accessing, or using SafeBites, you agree to these Terms. If you do not agree, please do not use the App.
1. About SafeBites
SafeBites is a mobile application that uses artificial intelligence to analyze restaurant menus for potential allergen concerns based on your selected allergies. SafeBites does not prepare, sell, or serve food and does not guarantee the safety of any food, restaurant, or establishment.
2. Eligibility
You must be at least 13 years old to use SafeBites. By using the App, you represent that you meet this requirement and that you can legally enter into these Terms.
3. Allergen Analysis Disclaimer (Important)
SafeBites provides informational guidance only.
- Allergen analysis is generated by artificial intelligence and may be inaccurate or incomplete
- Menu text extraction (OCR) may contain errors that affect analysis accuracy
- SafeBites does not guarantee allergen-free dining
- Food preparation practices can vary by time, staff, and location
- You are responsible for verifying allergen information directly with restaurant staff before consuming any food
SafeBites is not a medical service and does not provide medical advice. Do not rely solely on SafeBites for allergy safety decisions.
4. Subscriptions and Payments
SafeBites offers a free tier with limited scans and a premium subscription with unlimited scans and menu translation.
- All payments are processed through Apple In-App Purchases
- Subscription terms, pricing, and renewal policies are governed by Apple's terms
- You can manage or cancel your subscription through your Apple ID settings
- SafeBites does not collect or store payment information
5. Acceptable Use
You agree not to:
- Misuse the App or interfere with its operation
- Attempt unauthorized access to systems or data
- Reverse-engineer, decompile, or disassemble the App
- Use the App for unlawful purposes
- Excessively or programmatically access the App in a way that degrades service for others
We may suspend or terminate access for violations.
6. Third-Party Services
SafeBites uses third-party services to provide core functionality:
- Google Gemini API — for menu analysis and allergen detection
- RevenueCat — for subscription management
- Apple — for payment processing
Your use of these services is governed by their respective terms and privacy policies. We are not responsible for third-party service availability or accuracy.
7. Intellectual Property
All SafeBites branding, design, software, and content are owned by Voog LLC or its licensors and are protected by intellectual property laws.
You may not use our trademarks or assets without written permission.
8. Disclaimer of Warranties
SafeBites is provided "as is" and "as available."
We make no warranties regarding:
- Accuracy of allergen analysis or menu text extraction
- Availability or uninterrupted operation
- Fitness for a particular purpose
- Completeness of AI-generated results
Use of the App is at your own risk.
9. Limitation of Liability
To the maximum extent allowed by law, Voog LLC and its affiliates will not be liable for:
- Food reactions, allergic reactions, illness, or injury
- Losses resulting from reliance on AI-generated allergen analysis
- Inaccurate menu text extraction or translation
- Indirect, incidental, or consequential damages
10. Termination
You may stop using SafeBites at any time by deleting the App.
We may suspend or terminate your access if:
- You violate these Terms
- We are required to do so by law
- We discontinue the App
11. Changes to These Terms
We may update these Terms from time to time. Updates will be posted with a new effective date. Continued use of SafeBites after changes means you accept the updated Terms.
